MINOR PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION & PARENT/GUARDIAN AGREEMENT

PLEASE READ CAREFULLY

This Minor Participant Waiver, Release of Liability, Assumption of Risk, Medical Authorization & Parent/Guardian Agreement is entered into by the undersigned parent or legal guardian on behalf of the minor participant listed below.

1. PERMISSION TO PARTICIPATE

I am the parent or legal guardian of the minor participant named above. I give permission for my child to participate in wrestling practices, camps, clinics, open mats, conditioning sessions, drills, live wrestling, games, warmups, and related activities organized, hosted, supervised, or provided by EP Rattlers LLC.

These activities may take place at EP Rattlers facilities, partner facilities, rented facilities, competition locations, or other approved training locations.

2. ASSUMPTION OF RISK

I understand that wrestling and related training activities involve inherent and substantial risks. These risks include, but are not limited to:

  • Bodily contact with other participants;
  • Falls, throws, takedowns, mat returns, scrambles, and collisions;
  • Strains, sprains, cuts, bruises, mat burns, and joint injuries;
  • Concussions, head injuries, neck injuries, back injuries, fractures, paralysis, or death;
  • Overexertion, dehydration, heat-related illness, or conditioning-related injury;
  • Exposure to contagious illnesses, skin infections, ringworm, impetigo, staph, MRSA, flu, COVID-19, or other communicable conditions;
  • Injuries caused by other participants, coaches, equipment, mats, facilities, or ordinary negligence.

I understand that these risks cannot be completely eliminated, even with proper coaching, supervision, rules, and safety precautions.

I knowingly and voluntarily allow my child to participate despite these risks.

3. RELEASE OF LIABILITY

To the fullest extent permitted by West Virginia law, I, on behalf of myself, my child, and our heirs, personal representatives, successors, and assigns, release, waive, discharge, and covenant not to sue EP Rattlers LLC, its owners, officers, directors, wrestlers, coaches, volunteers, contractors, agents, representatives, affiliates, sponsors, facility owners, and partner organizations from any and all claims, demands, causes of action, damages, losses, or liability arising out of or related to my child’s participation in EP Rattlers activities.

This release includes claims arising from the ordinary negligence of EP Rattlers LLC or others, to the fullest extent permitted by law.

This release does not apply to claims that cannot legally be released under West Virginia law, including claims resulting from gross negligence, reckless conduct, willful misconduct, or intentional acts.

4. PARENT/GUARDIAN PERSONAL RELEASE

I understand that, as a parent or legal guardian, I may have my own claims arising from injury to my child, including but not limited to claims for medical expenses, loss of services, emotional distress, or related damages.

To the fullest extent permitted by law, I personally release, waive, discharge, and covenant not to sue EP Rattlers LLC and the released parties for any such claims.

5. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless EP Rattlers LLC and the released parties from any claims, damages, losses, costs, expenses, or attorney fees arising from:

  • My child’s participation in EP Rattlers activities;
  • My child’s conduct;
  • My own conduct as a parent or guardian;
  • Any inaccurate or incomplete medical, emergency, or registration information I provide;
  • Any claim brought by or on behalf of my child, except where indemnification is not permitted by law.

6. MEDICAL FITNESS & HEALTH DISCLOSURE

I certify that my child is physically able to participate in wrestling and related athletic activities.

I agree that my child will not participate if they are sick, injured, contagious, under medical restriction, or have any condition that would make participation unsafe for them or others.

I agree to notify EP Rattlers staff of any known medical condition, allergy, injury, medication, behavioral concern, or limitation that may affect my child’s participation or safety.

I understand that EP Rattlers LLC is not responsible for evaluating my child’s medical fitness and that I am responsible for seeking medical clearance when needed.

7. SKIN INFECTION, ILLNESS & COMMUNICABLE CONDITION POLICY

Because wrestling involves close physical contact, I agree that my child may be removed from participation if EP Rattlers staff believe my child may have a contagious illness, skin infection, open wound, suspicious rash, or other condition that could pose a risk to others.

I understand that EP Rattlers may require medical clearance before my child returns to participation.

I agree not to send my child to camp or practice with symptoms of illness, fever, vomiting, diarrhea, contagious skin conditions, or any condition that could put others at risk.

8. CONCUSSION, INJURY & REMOVAL FROM ACTIVITY

I understand that wrestling carries a risk of concussion and other serious injury.

I authorize EP Rattlers staff to remove my child from participation if they believe my child may be injured, ill, unsafe to continue, not following instructions, or creating a safety risk.

I understand that removal from activity may occur even if my child wants to continue.

EP Rattlers may require medical clearance before allowing my child to return after a suspected concussion, serious injury, illness, or unsafe condition.

9. EMERGENCY MEDICAL AUTHORIZATION

In the event of illness, injury, accident, or emergency, I authorize EP Rattlers LLC, its coaches, staff, volunteers, or representatives to seek or obtain emergency medical care for my child if I cannot be reached or if immediate care appears necessary.

This may include first aid, emergency medical services, transportation by ambulance, hospital care, urgent care, physician treatment, or other medical treatment deemed necessary.

I understand that I am responsible for all medical costs, ambulance costs, treatment costs, insurance deductibles, and related expenses.

10. RULES, CONDUCT & INSTRUCTIONS

I agree that my child must follow all posted rules, verbal instructions, safety directions, and standards of conduct given by EP Rattlers staff, coaches, volunteers, or facility representatives.

I understand that wrestling requires discipline, respect, and self-control.

EP Rattlers may remove my child from activities without refund for unsafe behavior, bullying, fighting outside instructed wrestling activity, disrespect, repeated failure to follow directions, poor sportsmanship, or conduct that interferes with the safety or experience of others.

11. PARENT/GUARDIAN CONDUCT

I agree to conduct myself respectfully while at EP Rattlers activities, facilities, competitions, camps, or events.

I understand that inappropriate parent or guardian behavior, including arguing with coaches, officials, staff, other parents, or participants, may result in removal from the facility or event.

I understand that EP Rattlers may remove my child from activities without refund if parent/guardian behavior becomes disruptive, abusive, unsafe, or inconsistent with EP Rattlers standards.

12. PERSONAL PROPERTY

I understand that EP Rattlers LLC is not responsible for lost, stolen, damaged, or misplaced personal property, including clothing, wrestling gear, shoes, phones, bags, money, water bottles, or other belongings.

13. TRANSPORTATION

Unless separately agreed to in writing, I understand that EP Rattlers LLC does not provide transportation to or from camp, practices, clinics, competitions, or activities.

I am responsible for timely drop-off and pickup of my child.

14. PHOTO, VIDEO & MEDIA PERMISSION

EP Rattlers LLC is given permission to photograph, video, or record my child during activities and to use my child’s image, likeness, or name for social media, website, promotional, educational, or club-related purposes without compensation, unless otherwise notified.

15. REFUND / REMOVAL POLICY

I understand that camp fees, clinic fees, registration fees, membership fees, or drop-in fees may be non-refundable unless EP Rattlers LLC chooses otherwise.

I understand that removal for misconduct, unsafe behavior, illness, injury, failure to follow rules, or parent/guardian conduct does not guarantee a refund.

16. GOVERNING LAW

This Agreement shall be governed by and construed under the laws of the State of West Virginia.

17. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. ACKNOWLEDGMENT

I acknowledge that I have read this Agreement carefully and understand its terms.

I understand that this Agreement includes an assumption of risk, release of liability, waiver of certain legal rights, medical authorization, and indemnification agreement.

I understand that I am signing this Agreement voluntarily.

I certify that I am the parent or legal guardian of the minor participant named above and have authority to sign this Agreement.
